1. Scope of Application

1.1 Fondazione Collegio Europeo di Parma, headquartered at Strada dell’Università 12 – 43121 Parma (PR), Italy, offers an online platform under the domain www.europeancollege.it for accessing video courses and e-learning materials (hereinafter referred to as the “Platform”).

1.2 These GENERAL TERMS OF SERVICE apply to all individuals registered as users of the Platform (hereinafter referred to individually or collectively as the “User”). The GENERAL TERMS OF SERVICE govern the rights and obligations of Users when visiting the Platform and using its features and services.

1.3 The provisions of these GENERAL TERMS OF SERVICE may be modified by Fondazione Collegio Europeo di Parma at any time without the need to provide justification; such modifications will be announced on the Platform. If the User continues to use the Platform after being informed of changes to the GENERAL TERMS OF SERVICE, the modifications will be deemed as accepted.

1.4 Information regarding the protection of Users’ personal data is available in the Platform’s privacy policy at www.europeancollege.it/en/privacy-policy/.

2. Contract Purpose and Service Description

2.1 Users can access the video courses purchased through the Platform within a maximum of 8 weeks from the date of purchase.

2.2 If specified in the course description, the User will also receive, at the time of purchase, a promo code to be used on the platform www.orseu-concours.com. This promo code will be valid for 2 months from the time of purchase.

3. Registration and Consent

3.1 Registration is required in order to access the Platform. By registering to the Platform, the User agrees to the validity of these GENERAL TERMS OF SERVICE. Access to the Platform is restricted to registered Users.

3.2 To register, the User must provide complete and truthful information and promptly update any changes.

3.3 There is no entitlement to registration on the Platform. Fondazione Collegio Europeo di Parma reserves the right to deny registration to any individual without stating reasons or to prevent registered Users from using the Platform without providing justification.

4. Users’ Rights and Obligations

4.1 The User agrees to keep their access credentials to the Platform confidential. The User is responsible for all activities originating from their User account.

4.2 The User agrees to immediately notify Fondazione Collegio Europeo di Parma if they suspect unauthorized use of their User account. If unauthorized use of an account is suspected, or if a User violates applicable laws or these GENERAL TERMS OF SERVICE, Fondazione Collegio Europeo di Parma has the right to block the User’s account.

4.3 The User agrees to access video lessons exclusively through the Platform and not to copy and/or distribute the video lessons or any other content available on the Platform in any manner.

5. Use of the Platform

5.1 Fondazione Collegio Europeo di Parma makes the Platform available 24/7. However, given the current state of the website, no procedure can guarantee that the software is entirely error-free. Therefore, Fondazione Collegio Europeo di Parma does not guarantee that the software underlying the Platform is completely free of errors or that the Platform will not experience interruptions. Additionally, the Platform may be temporarily unavailable for maintenance reasons. Fondazione Collegio Europeo di Parma will announce possible planned Platform maintenance; it is however not bound to update the Platform.

5.2 The Platform and its underlying software are protected by copyright and may not be used or modified beyond the granted usage rights without prior written consent by Fondazione Collegio Europeo di Parma. Likewise, the Platform’s design and, in particular, the content published on it are protected by copyright or other intellectual property laws and, unless otherwise stated, are owned by Fondazione Collegio Europeo di Parma.

5.3 The User agrees NOT to:

  • a) use any automated data collection or extraction technology, programs, algorithms, or methods to access, acquire, copy, or monitor the Platform and its content;
  • b) attempt to decipher, extract, disassemble, decompile, or reverse-engineer any software that is part of the Platform;

  • c) use the Platform for any unlawful purpose or in violation of any local, national, or international law, including, but not limited to, laws concerning intellectual property, copyright, and personal data protection;
  • d) remove, disable, damage, circumvent, or otherwise interfere with any security-related features of the Platform or its content, including features that prevent or restrict the use or copying of any content accessible through the Platform or that enforce limitations on the use of the Platform or its content;
  • e) modify, adapt, translate, or create derivative works based on the Platform or any content accessible on it;
  • f) interfere with or disrupt the Platform, its servers, or its network connection.
  • 6. Warranty, Withdrawal

    6.1 The legal warranty provisions apply to the relationship between the User and Fondazione Collegio Europeo di Parma.

    6.2 The withdrawal period is 14 days from the date of contract formation.

    6.3 To exercise the right of withdrawal, the User must notify Fondazione Collegio Europeo di Parma of their decision to withdraw from the contract through a clear statement sent to e-learning@collegioeuropeo.it . If a User opts for withdrawing, Fondazione Collegio Europeo di Parma will send confirmation of receipt of the request as soon as possible.

    6.4 Exception to the right of withdrawal: The right of withdrawal does not apply if the User has already accessed, in whole or in part, the video lessons available on the Platform.

    7. Governing Law, Jurisdiction

    7.1 These GENERAL TERMS OF SERVICE and all other agreements with Fondazione Collegio Europeo di Parma are exclusively governed by Italian law, except for the Convention on Contracts for the International Sale of Goods and relevant international private law. This choice of law only applies if the User is not deprived of the protection guaranteed by the mandatory provisions of the law of the Country where the User has their habitual residence.

    7.2 The Court of Parma has jurisdiction over all legal actions brought by a User against Fondazione Collegio Europeo di Parma arising from the contractual relationship. This does not affect the User’s right to take legal action in any other competent court. For legal actions against a User domiciled, habitually resident, or working in Italy, arising from the contractual relationship, jurisdiction belongs to one of the courts in the district where the User is domiciled, habitually resides, or works. For Users who are not domiciled in Italy at the time of contract formation, the relevant legal jurisdiction applies.

    8. Final Provisions

    8.1 If any provision of these GENERAL TERMS OF SERVICE is or becomes invalid, this will not affect the validity of the remaining provisions of the GENERAL TERMS OF SERVICE. The invalid provision shall be replaced with a legally valid provision that is as close as possible in economic intent to the will of the User and Fondazione Collegio Europeo di Parma.
